Civil and commercial mediation is the first service we offer to our clients facing a dispute.
Inspired by the American experience, mediation represents the preferred tool for dynamic justice in Europe. We offer mediation services to individuals as well as businesses.
Why Choose Mediation?
Mediation is an alternative to the judicial resolution of a dispute. It is provided for by law and offers two clear advantages.
The first advantage is that it allows for a quick resolution of the conflict.
The second advantage is to find a solution that does not depend on the judgment of the judge.
This solution is found through dialogue organized by the mediator.
What Does the Mediation Process Consist of?
The mediation process originates either from the agreement of the parties (voluntary mediation) or from a judge’s decision (judicial mediation). In both cases, mediation is a process based on three main phases.
First phase: the parties in mediation meet and have the opportunity to present their positions, each of them.
Second phase: the mediator invites the parties in mediation to specify what they hope to achieve and what they are willing to concede. This phase includes, if necessary, individual meetings between the mediator and each of the parties involved.
Third phase: under the guidance of the mediator, the parties negotiate the agreement autonomously.
Our Firm’s Intervention
We offer:
- upon the client’s request, our assistance during the mediation process as a “consulting lawyer”
- or upon a court’s request, we intervene as lawyer-mediators.
Our firm’s network also allows us to offer our clients:
- the intervention of an experienced co-mediator (doctor, psychologist, architect, engineer, accountant) if the technical nature of the dispute requires it
- the intervention of lawyers with specific language skills if the international or multicultural context of the dispute requires it
- intervention in Belgium and abroad
The Cost of Mediation
Mediation saves time and the costs of a judicial procedure that can last for months or even years. The cost of mediation must be evaluated based on the subject of the dispute. Our fees are agreed upon with clients during an initial meeting.
